Consumer Promotion Terms & Conditions:- Information and instructions on how to enter and cash back details form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- The offer is open only to residents of Australia, aged 18 years or older, who purchase any of the Qualifying NICORETTE® Products (specified within these terms and conditions) from participating Pharmacies in Australia during the Promotional Period.
- The offer is not open to employees (and their immediate families) of the Promoter, its agents, resellers and distributors.
- Promotion commences on the 28th December 2009 and ends 11:59pm AEST on the 5th of March 2010 or until the entire $30,000 cash back pool has been claimed, whichever is the earlier(“Promotional Period”). Claims must be received by last mail on the 5th of March 2010.
- To be eligible to receive a cash back, a claimant must, during the Promotional Period, (a) purchase a Qualifying NICORETTE® Product; (b)complete the original cashback card (claim card) available upon purchase, in participating Pharmacies; (c) attach the original barcode from Qualifying NICORETTE® Product and a photocopy of the relevant Pharmacy receipt(s); and (d) send to “NICORETTE® Quit & Win” PO Box 610 Surry Hills NSW 2010. Only claims completed on the official, original claim card will be accepted. Photocopied claim forms will not be accepted.
- Claimants may make one claim per month during the Promotional Period, and each claim must be related to a separate purchase of Qualifying NICORETTE® Product.

- An claim is only valid if all details are completed. Incomplete, indecipherable, incorrect or illegible claims will be deemed invalid. No responsibility accepted for lost, late or misdirected claims. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including an claimant’s identity, age and place of residence) and reserves the right to disqualify any claimant who the Promoter believes either has tampered with the claim process or has submitted a claim which is not in accordance with these Terms and Conditions. Claimants must retain their original receipts. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- The first valid claims received during the Promotional Period will receive a cash back of an amount depending on the Qualifying Product purchased. Promoter’s decision is final and no correspondence will be entered into. Cash back will be posted to claimants at the address included on their Claim Form, at the Promoter's cost. The total value of the cash back pool is $30,000.
- Recipients of a cash back will not have their names published, but will be notified via mail within 14 days, and receive their cash back within 28 days. Other claimants will NOT be notified.
- Any ancillary costs associated with redeeming the cash back are not included.
- If any prize (or part of any prize) is unavailable, the Promoter reserves the right to substitute any prize or prizes for a prize or prizes of similar specification or equal value to any prize or prizes offered in this promotion, subject to any written directions from a regulatory authority.
- To the extent permitted by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; or (e) any tax liability incurred by a claimant.
- All claims submitted become the property of the Promoter and will not be returned.
- No responsibility will be taken for cheques once they have been posted.
- The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any participant, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this offer (whether as a result of one of the foregoing causes or otherwise).
- If for any reason any aspect of this competition is not capable of running as planned, including (but not limited to) by reason of any cause beyond the control of the Promoter which affects the administration, fairness or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected claims, subject to state regulation.
- Claimant personal information ("PI") will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this, and future promotional activities. By entering this promotion claimants consent to the use of their PI as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, for the purpose of this promotion without any further reference or payment to the claimant. If the PI requested is not provided, the claimant may not participate in the promotion.
