Trade Promotion Terms & Conditions:

  1. Information and instructions on how to enter and prize details form part of these Terms and Conditions. Submission of an entry into this Promotion is deemed to be acceptance of these conditions of entry. Entries not completed in accordance with these conditions of entry are ineligible.
  2. Entry to the NICORETTE® “PAC Conference Trade Promotion 2010” (“Promotion”) is only open to residents of Australia that are employed as a pharmacy assistant and are aged at least 18 years old.
  3. Employees and their immediate families of Johnson & Johnson Pacific (“Promoter”), participating Pharmacists and their agencies associated with this Promotion are ineligible to enter the Promotion.
  4. The Promotion commences at 12am AEST 03/05/2010 and closes at last mail 30/06/2010 (“Promotion Period”).
  5. To enter, each entrant must: (a) fully complete the details required on the consumer research card (entry form) found in store including the details of the Consumer who completes the research card; (b) attach a copy of the Consumers NICORETTE® valid purchase receipt to the research card (entry form) (c) mail the research card (entry form) using the Reply Paid envelope supplied, to the promotional entry address - PO Box 610 Surry Hills NSW 2010.
  6. Illegible, late, invalid or incomplete entries will be ineligible to be entered into the draw and win a prize. Multiple entries will be accepted but each entry must be in respect of a separate Qualifying Enquiry.
  7. The Promoter reserves the right to verify the validity of entries & to disqualify any entrant who the Promoter believes either has tampered with the entry process in any way or has submitted an entry that is not in accordance with these conditions of entry.
  8. All eligible entries will be sent by Reply Paid Postage, back to the promotional entry box PO Box 610 Surry Hills NSW 2010, by the participating Pharmacy & go into the Participant Draw. All entries become the property of the Promoter.
  9. Eight (8) Minor Prize draws will take place every Friday at 2.00pm during the Promotional Period 03/05/2010 and 30/06/2010. While the final Major Prize draws will take place at 12 noon AEST Friday 09/07/2010. All draws will take place at Semcom Visual Communication – (the Promotion agency), at 9 Harris Street Pyrmont NSW 2009. Judges’ decision is final & no correspondence will be entered into. No responsibility will be taken for late, lost, indecipherable or misdirected entries. The drawn Participants will be contacted by phone on the day of the draw, and mail within 14 business days of the draw. Major prize winners also will have their name published in The Australian newspaper on 26/07/2010
  10. Minor Prize draws; - During the Promotional Period, one of eight (8) Minor Prize draws will take place every Friday at 2.00pm to win a AU$100 iSubscribe Gift Voucher to go towards a yearly magazine subscription of the winner’s choice. The voucher must be redeemed through www.isubscribe.com.au. Any ancillary costs associated with redeeming the voucher are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher. The total secondary prize pool is valued at AUD$6400 (incl GST).
  11. Major Prize draws; - The first valid trade entries drawn from the barrel for each State group (NSW/ACT, VIC/TAS, SA/NT & WA/QLD), will win a trip consisting of: two (2) adult return economy tickets to Gold Coast, flying from the winner’s nearest capital city. Prize includes: Three (3) nights twin share accommodation at the Holiday Inn Surfers Paradise (subject to change); Airport to hotel transfers at destination.
  12. Travel departure and return dates must be taken between 28/10/2010 to 31/10/2010 and will be nominated by the Promoter up to 14 days prior to departure. Travel will only be valid on dates specified by the Promoter. All non-cash prize components of the Major Prize are not redeemable for cash. In the event that a Prizewinner cannot or does not want to attend the Major Prize, the Prizewinner may appoint a proxy over 18 years of age to take the applicable Major Prize, taking it on the same conditions as specified herein. The Prizewinner must take out their own travel insurance for both guests travelling, prior to departure and as a condition of acceptance of the travel prize. Flights and accommodation are subject to booking and availability. No meals are included. All other costs associated with the prize including but not limited to additional spending money, any additional transfer costs, taxes, travel expenses to and from the departure point within Australia, insurance, and other ancillary costs are the responsibility of the winner and their companion. It is a condition of accepting this prize that the winner and his/her companion must sign a release and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this Promotion or providing the prize prior to undertaking the activities included in the prize. If a winner or their nominated companion does not sign the release form provided by the Promoter within the time requested by the Promoter, the winner’s entitlement to the Major Prize will be deemed invalid. Frequent flyer points will not form part of the prize. Major Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in. Prize is valued at up to AU$11,500 (incl GST) (depending on point of departure).
  13. The Major Prizes may be subject to the conditions of the supplier of the prize and the Promoter and its related bodies corporate are not responsible or liable for any direct or indirect loss suffered by any entrant as a direct or indirect result of the conduct of the supplier.
  14. In the event for any reason a winner does not take an element of the prize by any specified date then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. Any costs in excess of the value of the prizes (including GST) and all ancillary costs associated with redeeming the prize are the responsibility of the Prize winner.
  15. The Promoter reserves the right to issue a disclaimer that must be signed by the Prize winner, prior to the Major Prize Value Draw. If the Promoter is unable to supply the nominated prize, the Promoter reserves the right, subject to the written directions of any competent authority, to supply another prize of greater or equal value. Prizes are not transferable or exchangeable.
  16. To the extent permitted by law, the Promoter, participating Pharmacies any of their associated agencies shall not be liable for any loss, cost, damage, expense, personal injury, death or liability (including, but not limited to direct, indirect or consequential losses) that is suffered or incurred in connection with this promotion, the use of a prize or accepting any prize, or any act or omission (whether negligent or not) of the Promoter, participating pharmacies or their associated agencies, or any person associated with any of them including their employees or agents or otherwise.
  17. The Promoter accepts no responsibility for any tax implications for the prize winner that may arise in relation to the prizes and winners should seek their own financial advice.
  18. The Promoter reserves the right to request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
  19. If any Major Prizes remain unclaimed after 26/07/10, an unclaimed prize draw will take place, subject to any written directions under the relevant state authority. The unclaimed Major Prize draw will take place at 12pm AEST on 03/09/2010 at 9 Harris Street Pyrmont NSW 2009. Prize winner will be notified by phone and mail within 5 days of the unclaimed prize draw & will have their name published in The Australian newspaper on 13/09/2010.
  20. Any unclaimed Minor Prizes will be redrawn at 12pm AEST on 08/10/2010 at 9 Harris Street Pyrmont NSW 2009. Prize winners will be notified by phone on the day of the draw, and mail within 14 business days.
  21. If for any reason this Promotion is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right in its sole discretion to cancel, postpone or amend the Promotion, subject however to the written directions of any competent authority including any written directions given under the relevant state authority.
  22. Winners acknowledge that they may be asked to participate in publicity and promotional activity in relation to the Promotion including but not limited to newspaper, television and or radio interviews or appearances and that the Promoter reserves the right of use and reproduction of any publicity material without any financial re-imbursement to the winner. Entrants’ personal information ("PI") will be collected to enable the Promoter to administer and promote this Promotion and its winners. The PI of winners may be provided to others assisting, including prize suppliers and deliverers, and to authorities that regulate this Promotion, and for publication as required under the legislation regulating this Promotion. If the PI requested is not provided, the entrant may not participate in the Promotion. If an entrant does not truthfully provide all requested PI, the Promoter may determine the entrant is not eligible to win a prize.
